We flew over to rebel landed outside it he comes around the corner (Out of hearing range) and then as we take off shoots us both. He claims to have initatiated but if that is true there is no way we could have heard

From the video it is clear that no high quality RP was provided to lead you to getting shot. It is up to the agressor to ensure that the party he is talking to is aware of his demands and he has provided high quality RP to result in you being shot. As such a ban will be issued for both players
