Police failed to RP and instead attempted to RDM Civ

So I read the below:

I was watching my friend play the game when this occurred. The car was pulled over, an as the above describes, the hostage explained the situation. The police man CC Killerabbit opened fire instead of initiating RP, in response, the Civ myles438a ran away, took out his gun and fired back, killing the police man, which resulted in a ban (now unbanned). Can someone explain to me why myles438a was banned, and the police man CC Killerabbit was not.

Well by this rationale if police speak to us and we don't agree we can just open fire and say nothing then, sounds good to me
