Unban Appeal for JamesShaw

In-game Name: Sam Spice

Server: GTA RP

Steam ID: 76561198800026672

Ban ID: !!rpuk13773!!

Reason given for your ban: Metagaming

In your own words, please type why you think you were banned.: In regards to my last unban appeal, I did write my own unban appeal and all my replies. I guess the fact I was streaming again came back to bite me another time. I am fully aware of the fact that if I get someone to else to write my appeal it would only get denied much quicker. It was a mistake to open up the second appeal, I worded it entirely wrong when I stated I wrote other's appeals. What I meant to say was that I helped others to write their appeals, however it was written solely off of their own back. I shouldn't have thrown my toys out of the pram, but rather just explained that it was indeed myself who had wrote the appeals. Just to ensure that there are no mixed messages about the author of this appeal I won't stream any part of it.

I believe I was banned by staff for the potential reason of foul play whilst Marabunta and Grove were continuously fighting. Staff were correct to take that precaution and to make sure it is a fair playing field for everyone in the game, as it ensures no group has a huge advantage over another in terms of what they should not know within RP. These types of advantages could be anything along the lines of positioning - Where abouts they are coming from and certain higherup positions they could be placed on. In addition to this the amount of individuals still standing from the opposing side. Both of these factors that could have drastically benefitted Mara and changed the gunfight essentially helping them to win. It is understandable that it looks as if I am trying to aid 1 side of the war through myself streaming my cop characters POV and for some it could look like an unremovable birdseye view, as neither Mara or Grove will want too shoot at cops. However that was not my intention in the slightest. Whether I am on my cop early in the morning and streaming the Drug dealing chases or myself driving a taxi, I commonly stream in that channel. Unfortunately from another point of view such as Grove or Staff, me streaming whilst the fight is on going looks to be myself breaking the metagaming rule. As I have said previously my intentions are nothing but pure and nothing out of spite for any parties involved. Despite this, I should have taken it upon myself to not stream as it could have potentially ruined the RP for all individuals involved. For that I apologize and given the chance to return is definitely not a path I will be going back down.

My RP with individuals in Grove has been enjoyable such as that with Ghost which went on for a while. In addition to that other scenarios involving Grove members and them being arrested and eventually sent to Prison. I simply want too highlight that my intentions weren't to just show up to a gunfight stream it and then leave as it comes to an end. I hope everyone involved in the situations can agree that it was fair for all individuals involved and that there was no underlying hatred for anyone there.

I had spoke to BMAV the day before regarding the Metagaming allegations and the belief that I was streaming to provide Marabunta with an advantage over Grove. In the call I had explained that there was no foul play from anyone involved in the discord and that it is simply a common place for everyone to stream within. Whether that be playing other servers or other games, a large amount of the community are involved in the discord and regularly will chat in there. To back up my statements I provided BMAV with a clip of a situation with happened only a few hours previously which show myself In the Mara discord streaming whilst talking to everyone in the call. I had been streaming a solid part of a few hours at that point before the Grove situation with police kicked off leading to a shootout. Whilst in the call I had told BMAV about the fact that when it does come to Marabunta and Grove fighting everyone is typically deafened up except from people who aren't in the server or in the gang.

It is totally understandable that beliefs of metagaming could have taken place, especially due to the fact I was streaming in the Mara discord whilst they were actively fighting Grove. If it was in a different discord I'm sure no questions would have been asked as they aren't involved in the situation. However even when I was in the Mara discord I wasn't solely just targeting to stream as they were engaging in a gunfight. I had been streaming numerous other cop related things and 229 vs Aztecas, where I would typically sit on Callaghan Tower with binos.
Since coming back to the Server in January after my unban I have generally tried to keep my head down and not place myself in the eyes of staff. After speaking to BMAV I should have taken the hint to stop streaming, however I generally didn't think it would eventually lead to a G3.1 as nothing I was streaming was being used ingame. Although it eventually did land me in hot water, and I'm happy that it was a wake upcall to myself to be more careful with what I am streaming whilst in discord as it can be interpreted a vast array of ways.

Despite me streaming and potentially giving Mara individuals an advantage over Grove, it wasn't used by anyone in the discord that way. However as Liam highlighted that doesn't change the fact it could have been used. Not only did it potentially put me at chance of getting banned for G3.1 but it could have also affected a large amount of other people.

Why should we unban you ?: Over my time on the server I have enjoyed every moment whether it's a win or a loss. I know everyone says this but RPUK is without a doubt the best server you can find yourself being a part of. The sheer amount of opportunities available to the community and different RP stories you can find yourself in is like no other server out there. However I have broken the trust of staff numerous times before and I'm sure this unban appeal will raise questions to whether or I not I intended to use my stream as an advantage for Marabunta. However, I generally do want to RP on the server and since my unban in January I have improved my RP drastically. It would never be my intention to deliberately break a rule on the server especially after how lenient staff have been with me over the last year. I have had many opportunities which I took for granted and ended back up in the unban section. I didn't see myself ending back up here again yet so soon after my last unban. I am disappointed in myself for not stepping back and looking at the bigger picture which was my time on the server. Myself streaming in the discord looked suspicious and I should have simply taken myself out of the equation. However I would like to reiterate that no metagaming took part from myself or any other individuals in the call. Whether I am an unbanned or not is entirely is up to staff, but I stick by the fact that the stream wasn't used maliciously by anyone.

However it is my responsibility to ensure it is fair for everyone and not give people that chance to break rules as it isn't acceptable to give 1 side that advantage. As asked previously about why I was targeting my stream around the area of Marabunta and Grove gunfights this isn't the case, I assume it was just whoever was watching for my streams in the discord checked at them times of the day. If staff ever do want to see them clips I would be more than happy to provide them, hopefully that will give a little insight into the discord stream.

Thank you for taking time out of your day to read my appeal.

Please confirm that you have read the unban appeal process and rules: Yes

Oh, hello..

Welcome back.

Don't get us (me) wrong. If someone who cannot get their point across in words, or wants a bit of help on their appeal. They can ask for assistance by their friends, it is only an issue when someone else is writing their appeal for them.

Now, if both your appeals. We were very much raising an eyebrow at the fact that you were streaming your Appeal to Marabunta Discord and assumed that your appeal was being written by them. Which made even more sense with your statement that you write other peoples appeals too.

Anyway...........................................moving on...

So, I have a clip from one of your liaisons with Bmav. Where you have stated, that no foul play went on and that you said for an absolute fact that there was no-one even in the channel that you were streaming in but this was false...If you weren't doing any wrongdoing, why lie?

Personally? I find it odd to only Stream to Marabunta when its a gunfight with Grove v Marabunta. The thing is, intentional or not people will metagame it. They might see you arresting some Grove street thug around the corner away from the gunfight and go interact with them in RP, humans are humans....

Thank you for the reply @Liam

Yes it would have been false, I was in a call with a few Marabunta individuals. I wish I could say I remembered everything I had said whilst in the call with BMAV, unfortunately I don't. You ask why I would lie, I had no reason to lie to BMAV, whether it was through better discord or someone who had access to the room, they could see I was in a call with people and BMAV would have known this as well. To lie there would be no sense behind it. However I was in the middle of RPing with Ghost who was in the cells actively talking to me whilst I was also writing up the Police report for the situation. I'm not trying to make excuses here although it may look like I am so I had my mind in two different places at the same time. If anything was meant to come out of my mouth along them lines it would have been that the people who were watching my stream and I was talking to were not in game at that moment. Despite this you are correct, I shouldn't have been streaming in the discord due to the potential chance of something getting metagamed. Possibly leading to the good RP being tarnished by something such as an individual possibly watching the stream getting involved within RP. The two people who were watching my stream whilst speaking to me were Rob and Kev, whilst everyone else in RP was deafened. I do have a clip of this been streamed in discord with them two being the only speaking to me whilst the situation was going on. Staff are correct in the fact that the stream should have been cut off whilst in these types of sensitive situations.

In terms of streaming in the Marabunta discord when it's a Marabunta vs Grove, it isn't only Mara that are in the discord. Sometimes there are other individuals in the call from other gangs. However yes I shouldn't be streaming the Gunfight when I'm in their discord due to the potential risk of as you say humans being humans and using that information to benefit themselves during a gunfight. That leads to Grove being at a huge disadvantage and it isn't fair on them to be in that position. I apologize to any Grove that feel like I was trying to cheat them out of a fair fight.

Thanks for reading

What do you think you've learned from this ban, and the appeals?

Thank you for the reply @Liam

That before opening up a stream on discord you should be careful about what is being streamed. As it can easily land you in hot water. It has been a wake up call to say the least that although you aren't trying to benefit another group, by myself streaming it has given them that option which isn't fair on other parties involved.

From this ban I have learnt, sometimes what you think is not going too have an impact such as myself streaming can have consequences, both in game and out of game. It has led to myself getting banned which could have easily been avoided given I hadn't been streaming during them sensitive situations. It has shown me that it can be perceived a numerous of different ways, such as myself trying to give Mara a birdseye view of the gunfight. Given I have the chance to be unbanned it is something that I will not be doing again. It was never my intention to try and break a rule, especially after the amount of second and third chances I have been given.

From the appeals, I have definitely learnt not to be streaming them and its probably not a good idea to be streaming them in the discord which people believe I was trying to help. It's important for staff to know you have a concept of what rules you broke, so for the future you don't fall down the same path.

Thank you for reading the appeal

I am shocked, and surprised at how many warnings you've had over bans. You have broke a total of 14 rules in your short time here of 1 year and 4 months. Whilst I appreciate the effort, and detail that you've put into this appeal. I simply cannot let it slide that you have a complete disregard for the rules on this community.

Thus we come to the conclusion of -

You may re-appeal this ban 13/11/2023

Take this cooldown as a blessing is disguise, you need to really think about your place here instead of a few warnings here and there and getting away with it.
